Like most jurisdictions, gambling in Nevada is prohibited unless licensed. Local governments, however, typically perceive licensing as a method of taxation, and rarely use their powers in a regulatory fashion. Local city and county governments have concurrent authority to license and regulate gaming. The five part-time Commission members make final determinations regarding licence application approvals, the adoption of regulations and disciplinary action for regulatory violations by licensees. In this regard, the Board conducts auditing, tax collection, criminal and civil enforcement of the gaming laws and regulations, equipment approvals and licensing investigations. The three-member Board is the full-time administrator of the gaming laws and regulations and makes recommendations on licensing matters to the Commission.
Nevada delegates the authority to license and regulate gambling to two agencies: the Nevada Gaming Control Board (the “Board”) and the Nevada Gaming Commission (the “Commission”).
